Terms of Use

These terms cover the Crosswordy app for iPhone and the Crosswordy Plus subscription. By using the app you agree to them. If you don't, please don't use the app.

Who you are agreeing with

Crosswordy is made and published by Daniel Koutris, an individual trading as Crosswordy, based in the Commonwealth of Massachusetts, United States. "We", "us" and "our" in these terms mean that person. You can reach us at support@crosswordy.app.

The app

Crosswordy is licensed to you, not sold. You may use it on Apple-branded devices you own or control, as permitted by the Usage Rules in the App Store Terms of Service. The licence is personal and non-transferable. You may not resell it, redistribute it, or attempt to extract its puzzle or clue data for redistribution.

Crosswordy Plus

• Plus is an auto-renewing subscription, offered monthly or annually. The exact price is shown in the app before you buy, in your local currency.
• Payment is charged to your Apple Account when you confirm the purchase.
• The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
• You can manage or cancel your subscription in the App Store, under your Apple Account settings. Deleting the app does not cancel a subscription.

Refunds

Purchases are made through Apple, and refunds are handled by Apple under their policies. We cannot issue refunds directly. You can request one at reportaproblem.apple.com.

Puzzles you build

Puzzles you create in the app are yours. Because they are stored on your device and shared only through links you send yourself, we neither host nor moderate them. You are responsible for what you put in a puzzle you share. The app filters titles and clues against a blocklist of offensive terms, but that filter is a safeguard rather than a guarantee.

Don't use the app to send someone material that is unlawful, harassing, or sexual content involving minors, and don't use it to try to reach people who haven't asked to hear from you. There are no accounts here, so the only thing we can act on is the puzzle itself.

Reporting a puzzle

If someone sends you a puzzle you think shouldn't have got through, "Report this puzzle" appears on the screen you see when you open a shared link, and in the puzzle's action menu. Reporting hides that puzzle on your device and refuses the same link if it arrives again.

A report emails us the link, because the link is the puzzle — there is no stored copy anywhere for us to look up. What we can do in response is fix the filter and ship the fix to everyone, which is a real remedy but not the same as taking one item down. We are careful not to promise a takedown that isn't possible.

Your data

Your puzzles and progress are stored on your device, and sync between your own devices through your private iCloud. We hold no copy of them and cannot see into that iCloud database, so we cannot restore anything for you. See the Privacy Policy for the detail.

Availability

Daily puzzles are published to a hosting service and downloaded by the app. We aim to publish every day, but we don't guarantee uninterrupted availability. If the service can't be reached, the app will tell you so; puzzles already downloaded, and the random-puzzle generator, keep working offline.

Apple's part in this

Crosswordy is distributed through the App Store, and Apple requires us to say the following. All of it is true and none of it is boilerplate we would otherwise leave out.

• This agreement is between you and us alone. Apple is not a party to it, and we — not Apple — are solely responsible for Crosswordy and its contents.
• We are solely responsible for any maintenance and support for the app. Apple has no obligation to provide either.
• To the extent any warranty is not effectively disclaimed, we are responsible for it. If the app fails to conform to a warranty that applies, you may tell Apple, and Apple may refund what you paid for it; beyond that refund, Apple has no warranty obligation to you.
• We, not Apple, are responsible for addressing any claim that the app or your use of it fails to meet a legal or regulatory requirement, breaches consumer protection law, or causes harm — and for any third-party claim that the app infringes their intellectual property.
• You confirm you are not located in a country subject to a US Government embargo or designated as supporting terrorism, and that you are not on any US Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these terms and have the right to enforce them against you.

No warranty, and limits on liability

The app is provided "as is", without warranties of any kind to the extent the law allows. To the maximum extent permitted by law, our total liability arising out of the app is limited to the greater of the amount you paid us in the twelve months before the claim, or twenty US dollars. We are not liable for indirect or consequential loss. Nothing here excludes liability that cannot lawfully be excluded, and some jurisdictions do not allow these limits, in which case they apply only as far as they legally can.

Ending access

You can stop using the app at any time by deleting it; cancelling a subscription is separate, and done in your Apple Account settings. Because there are no accounts, we have no ability to suspend an individual user — the licence in these terms ends if you materially breach them, and what we can enforce in practice is the filter and the reporting route described above.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law rules, and the state and federal courts located in Massachusetts have exclusive jurisdiction over any dispute arising from them. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your own country.

Changes

These terms may change as the app changes. The current version is always at this address, with the date above.
